What Are Trustee Documents?

Trustees may encounter a variety of documents while establishing, managing, or administering a trust. Depending on the document and how it has been prepared, one or more signatures may require notarization.

Trustee documents may include acceptances, successor trustee documents, affidavits or declarations, certifications, and other trust administration paperwork.

TRC Mobile Notary does not prepare trustee documents, interpret trust provisions, or determine whether a particular document requires notarization

Each person whose signature is being notarized must personally appear before the notary, provide acceptable identification, be able to communicate with the notary in English, and complete the requested notarial act willingly and without coercion.

Important: The Notary's Role

TRC Mobile Notary does not prepare trustee documents, provide legal advice, interpret trust provisions, determine a person's authority to act as trustee, or determine which notarial act a signer should choose.

If a trustee document does not contain a notarial certificate or there is uncertainty about how it should be notarized, please contact the attorney, document preparer, financial institution, or receiving organization for instructions before the appointment.

A notarization documents the notarial act performed. It does not determine the legal effect, accuracy, or validity of the trustee document, the signer's authority as trustee, or the underlying trust.
