For any notarization, the patient must: Be alert and aware Be willing to sign Be able to communicate clearly If a patient is unconscious, heavily sedated, or unable to demonstrate awareness, I am legally unable to proceed.

If the signer is not fully aware or cannot communicate clearly, I am legally unable to complete the notarization. This is required under California law to protect the signer.
