What Is a Certification of Trust?

A Certification of Trust is a document that provides certain information about a trust without requiring the complete trust document to be presented. It may identify information such as the trust, trustee or trustees, and the authority granted under the trust.

A Certification of Trust may contain one or more signatures requiring notarization depending on how the document has been prepared and the instructions provided.

TRC Mobile Notary does not prepare Certifications of Trust or determine whether a document requires notarization.

Mobile Certification of Trust Notary Services

A Certification of Trust signing does not always need to take place at an attorney's office. Mobile appointments can be arranged at a location that works for the signer.

Certification of Trust Signings

Certification of Trust documents may be prepared as part of an estate planning, trust administration, financial, or real estate matter. The document may involve one or more trustees whose signatures require notarization.

Each person whose signature is being notarized must personally appear before the notary, provide acceptable identification, be able to communicate with the notary in English, and sign willingly without coercion.

Certifications of Trust With Multiple Trustees

A Certification of Trust may contain signatures from more than one trustee that require notarization. Before scheduling, it is helpful to determine which individuals will be signing and how many signatures require notarization.

If multiple trustees need their signatures notarized, they may be able to complete their notarizations during the same appointment when everyone is available at the same location.

What to Have Ready

Important: The Notary's Role

TRC Mobile Notary does not prepare Certifications of Trust, provide legal advice, interpret trust provisions, or determine which notarial act a signer should choose.

If a Certification of Trust document does not contain a notarial certificate or there is uncertainty about how it should be notarized, please contact the attorney, document preparer, or receiving organization for instructions before the appointment.

A notarization documents the notarial act performed. It does not determine the legal effect, accuracy, or validity of the underlying Certification of Trust or other estate planning documents.
