What Is a Trust Amendment?

A trust amendment is a document used to make changes to an existing trust without replacing the entire trust document. Depending on how the amendment has been prepared, it may contain one or more signatures that require notarization.

Trust amendments can vary significantly, so the document should be completed and prepared before the appointment, with the appropriate notarial certificate or instructions provided by the attorney or document preparer.

TRC Mobile Notary does not prepare trust amendments or advise clients on how a trust should be changed

Trust Amendment Signings

Trust amendments may be prepared to update certain provisions of an existing trust. The document may involve one or more trustees or other signers whose signatures require notarization.

Each person whose signature is being notarized must personally appear before the notary, provide acceptable identification, be able to communicate with the notary in English, and sign willingly without coercion.

Trust Amendments With Multiple Signers

A trust amendment may contain more than one signature requiring notarization. Before scheduling, it is helpful to determine which individuals will be signing and approximately how many signatures will require notarization.

If multiple signers are available at the same location, their notarizations may be completed during the same appointment.

Important: The Notary's Role

TRC Mobile Notary does not prepare trust amendments, provide legal advice, interpret trust provisions, or determine which notarial act a signer should choose.

If a trust amendment does not contain a notarial certificate or there is uncertainty about how it should be notarized, please contact the attorney, document preparer, or receiving organization for instructions before the appointment.

A notarization documents the notarial act performed. It does not determine the legal effect, accuracy, or validity of the underlying Certification of Trust or other estate planning documents.
